Or maybe they'd have a motive. But to be able to order someone to kill a victim you need to know at the very least of the victim's existence or possible existence. You can't order to kill someone concrete without tagging them concretely.

Lawfully, only B and C are in the wrong. B would be punished for ordering the death of D, and C would be punished for carrying out the deed. Not sure how D would ever be at fault, though. Unless you're saying they deserved to be killed by a hitman for one reason or another.
