Asking About tarnishing intellectual property

Hello, I need to ask and confirm a few things.

I currently developing my game with RM VXA, and it already underway for years
this where the idea come few years ago where we ended up redrawing some of VXA and MV Default Character (Yes, i have buy both VXA and MV on steam) to be look more "Grown Up" or more "Modern?" with some slight change in design and personality

and few days ago, we reach the development of the CG Scene part, and we have idea to make some "R18 Scene" for this character to spice things up....

but we kinda worried because we don't own this character in the first place... they owned by the Degica
i wonder if they allow / forbid their Default Character to be drawn in such a way ?
or if we do, will they consider it as tarnishing their intellectual property and may send C&D to us ?

The assets included in RPG Maker are there for you to use. You got the right to use them, and edits of them, when you purchased the software.

You can read the EULA yourself - it does not place any restrictions on using RTP assets in adult games.

I guess the moment you age them up they're no longer *the* characters?
so, that'd be considered "inspiration" not "plagiarism"?

That doesn't have bearing on it. In this case, you've been licensed to use the characters, without much restriction.

@pawsplay right... but they're not using the characters as they come, there's a modification in the middle.

I don't recall seeing any restriction in the user agreements for "type of content" they can be used in. I think the most onerous thing I saw was some restriction that they couldn't be used in programs outside of RPG Maker? But, it's been a while since I've read the User Agreement stuff.

So, like, you couldn't shove them into Unity and make money from them there. Or, something like that.

But, no restriction on usage of the characters or program to make "H Games" or even "R18 Scenes". Even passing through any specific kind of website for a few minutes might lead you to footage of people who are obviously playing very adult games using RPG Maker (and those games are designed sooooo badly most of the time! WHY YOU GOTTA MAKE SUBPAR CONTENT WITH THE MAKERS, YOU PEOPLE?! At least put some effort in!). None of those ever get a C&D or get taken down. Though, the "stolen artwork" in some of those games can be flagged.

So, if it's your own custom artwork or whatever, I think you're okay. Even if you're using the defaults of what came with the programs, I'm pretty sure it's okay. You purchased the programs, so you also purchsed the "license" to use the assets. Usage is limited, but not in the way that it would restrict your usage.

Actually, they can. There was an edit to the EULA earlier this year that stated any official RPG Maker assets that you legally own can be used in any game maker you own.

You have no idea. While I'm not a "connoiseur" of those types of games... ones that are well-made in RPGMaker are extremely few and far between. As in, much lower quality than your average RPG Maker Shovelware title on Steam. Which... says something.

@ATT_Turan I stand corrected. That's pretty good to know.
