Artwork still counts, which is why Disney can and does shut down businesses that prominently display fan work of their characters.  Just because it's hard to enforce an IP violation doesn't make it magically not a violation.

In the past Hasbro was more loose with their copyright defense.  Know what happened?  They lost their rights to some of their characters!  This is why they're so harsh on any fan creation that could be considered competing properties like the games.  They've been really free with things that don't compete though, and I don't think it's right to mock that kind of generosity.  The fan community is part of what makes MLP FiM awesome, but the other part is that Hasbro is doing everything it can to keep it awesome for everyone.

Not to be skeptical, but being 'nearly 100% sure' that people wont get in trouble is simply not good enough. IF someone who used them did get into trouble, this wouldn't affect YOU at all, but it would sure as hell affect THEM.

To be perfectly frank. Using these images, would show a poorly designed game that clearly did not have any thought behind it, or how it would affect other games/companies...

You have a fair point but the fact still stands that a fanbase is a companies main source of income and only a fool would attempt to make their fanbase hate them because then they wouldn't buy their products. So it's generally a rule of thumb for most companies to let artwork slide as long as people aren't getting a profit from it.

I love it when someone's respect and "omg make me one!" fanboying goes out the window when they realize that they didn't make them from scratch and are simply using other resources to create said sprites.

You think it's easy making sprites? By all means prove this. I may have simply used a sprite base but I COLORED and ADDED EVERY SINGLE DETAIL to those sprites from the bases which took me DAYS to finish.

The base is from the resources I mentioned earlier with the link provided in my OP, I can even upload the sprite bases and sprite parts I used to build these to prove this. In fact:

Unfortunately it isn't that simple - and I'm not talking about whether someone profits from fanmade work or not.
If copyright violations (inlcuding free fanmade, non-com stuff) becomes too common, a rival company can try to have an artists/authors/developers copyright declared voided based on the fact that he/she allowed fans to violate his/her copyright without getting prosecuted.


An author who is basically pro-fandom once wrote why he can't allow fanfics. Go to the following link, and click on the question about fanfic (from Jan 2011) and read that...

Let me toss out a couple of things.

Trademarks are the weakest form of IP protection - they must be actively 'protected' by the owners or they risk losing their mark. That's what Sharma was referring to (you can't lose a copyright or a patent - patents are the strongest form of IP protection, hence the more limited terms). It isn't a case of Hasbro being nice or not nice - it's a case of Hasbro invested a lot of money into something and doesn't want to lose that investment because they didn't follow the due diligence the law requires.

What you feel, think, believe, hope, want makes absolutely no difference in a courtroom. The federal statutes do. And that's where Hasbro could find itself if someone challenges their trademark based on all the 'fandom' that went by without a peep.

If you're here on this site, there's a good chance you want to create something. You'll probably have some ideas of what you want to allow people to do or not do with the stuff you create. Hasbro (and every other content creator) has the same right to say how the stuff they created gets used.

so hopefully tomorrow i get to go home from the hospital i've been here for 5 days already and it's driving me mad. I miss my family like crazy but at least I get to use my own toiletries and my own clothes. My mom is coming to visit soon i can't wait to see her cause i miss her the most. :kaojoy:

Cartoonier cloud cover that better fits the art style, as well as (slightly) improved blending/fading... fading clouds when there are larger patterns is still somewhat abrupt for some reason.
