The gallery is full of user uploaded images and aren't moderated the way the forums are.  So it's a bit like asking if the images you find using a google search are available for public use.  Best to assume the answer is no and find resources from a more reliable location with attribution and usage rules right there with it.  Like in the resources section.  BTW, that particular image is a Holder battler, here's the link to his site: https://animatedbattlers.wordpress.com/
