Basically from my understanding BCj it's because legally they can't. They have edited rtp in the tiles, which while people are allowed to edit and distribute for free and commercial use, they aren't allowed to sell their edited tiles.
They may have sold them before, but as now they are known to be or have some rtp edits they cannot sell them without risking consequences and legal action being taken against them.
The only way for them to be allowed to sell them again, is if they get permission, aka strike some kind of deal I guess, because it sounds like they've gotten in trouble already because they sold the license. Another way would be for them to remove every single tile and only sell what they made from scratch, but that would require them a) to remember where exactly they used the rtp, and b) Most likely get permission and a clearance because of the past trouble it caused. Which they may or may not be able to get, I'm not entirely sure, however even then we wouldn't exactly know which tiles would remain available.
Furthermore, they cannot just make them free for commercial use because they previously charged money for the license, I don't know the details but to do this they would have to refund all the purchases of the license when it was available, if they haven't already. Again they would have to receive clearance I suppose and, as I said I don't know the details but the tiles could essentially be "black listed" for commercial use because of the legal issues.
