We understand that Nintendo has the right to send a Cease and Desist to us, and we wouldn't fight it. At least the sprites or did you have Nintendo's permission in making this? I know that some fan made games were being developed ( remake of chrono trigger anyone?) were shut down fairely soon before releasing the game. So my real question here is it okay to release games that contain other games sprites and things of that sort? As long as it's not commercial right? or how does the terms go about this. Thanks.

Most RPG Maker games do use assets/graphics/music from official games (mostly SNES JRPGs for that matter) if they don't use only the RTP. For better or worse, the practice is integrated into the community.
Generally, most major video game company's don't care if you release a fan game. C&D's are extremely rare and they only happen to games that somehow reach mainstream video game coverage, if at all.
