What was a Sword Art Online fna game, Now a fair use debate.

Hey, I'm looking for a team to develop sword art online, Since I'm a newbie, I'd like to see if anyone would help, I'm looking for sprites, I found some from RPG Maker VX, Aaannd.. I have no idea how to resize them, (Bruh, Im a noob.) SO Uhmm.. If someone could resize these.. that would be nice.

I've made SAO sprites for MV, but yeah.. don't wanna really give them out for free.


If you resize those Ace sprites, and use it on MV, trust me it will look horrible.

Yeah but... an exact recreation of SAO in RPG Maker? I just think it'll be pretty hard to pull off. But as I said, I wanna see where this goes

I think as long as he gives credit, uses as little of the source material as possible and doesn't make any money off it, it qualifies as fair use.

Making an entire game under the same name with the same characters and probably story doesn't fall under fair use though.

First of all, this is a fan game so basically your argument is invalid. Besides, if you make the resources yourself, how does that fall to copyright? I made those sprites myself.


It's called a "FAN GAME", entirely to support the franchise and the producer of the series.

First of all, your remakes do fall under fair use, but you did not make them yourself. They are modelled after copyrighted characters. Besides that, the fact that it's a fan game does not make my argument invalid. The law clearly states that it's prohibited to use, alter, share, sell anything under copyright law. The creator's of SAO will not come after you for a few MV remakes of characters, but if someone releases a full fangame that uses characters, music and whatnot... Believe me, they will oblige to take it down.

They probably are infringing. Just because it exists does not make it legal. In those cases, the content creator probably either a: Hasn't caught them yet, or b: have given them permission to use it or c: doesn't care. However, by law, if they find out about it and decide to file charges, you are immediately in the wrong, and fined a hefty fine.


Look up all the cases of what happened to any FF fan remakes. As soon as Square Enix got word of them, they sent them a C and D and ordered them to stop or else. King's Quest is another one, the fan made adventure game got a C and D when another company bough the IP, though they did eventually work out a deal to finish production legally. Still...the moral of the story is it's just best to not do it, and if you are, you are risking being sued every second you work on the project.

Actually, there is precedent in US fair use law that protects parodies of the work used, such as Abridged Series(es?).
